1. Parties & acceptance
These Terms govern the rental of motor scooters between BitScoot Resources ("we", "us") and the customer ("you", "Renter"). By placing a booking, paying a deposit, or taking possession of a scooter, you agree to these Terms.
2. Rider eligibility
- Minimum age 18 years.
- Valid motorcycle / scooter licence (class B / B2 / equivalent international). Tourists may use a valid foreign driving licence accompanied by a passport.
- You must not be under the influence of alcohol, drugs, or any substance that impairs riding ability.
- We may refuse rental at our discretion if eligibility cannot be verified.
3. Booking & deposit
- An online deposit of RM 100 secures your booking. A 5% Stripe processing fee is added so the full RM 100 reaches BitScoot — total charged to your card is RM 105.
- The deposit is held until the scooter is returned. It is refundable in full if no damages, no fines, no fuel deduction, and on-time return.
- The balance of the rental (daily rate × days) is settled in cash, FPX, or card at pickup.
- Bookings are reserved on a first-paid-first-served basis. If the model you selected becomes unavailable due to a prior booking or repair, we will offer a substitute of equivalent class or a full refund of your deposit.
4. Cancellation & refund
| Cancellation notice (before pickup) | Refund |
|---|---|
| ≥ 48 hours | Full deposit refund (less RM 5 processing fee) |
| 24–48 hours | 50% deposit refund |
| < 24 hours / no-show | Deposit forfeited |
Refunds are processed within 5–10 business days via the original payment method. Weather-related cancellations (e.g. red-alert storm warning) are handled compassionately on a case-by-case basis.
5. Pickup & return
- Scooter is delivered or picked up at the address agreed via WhatsApp. Hotel delivery fee: RM 20–40 depending on location.
- You must inspect the scooter and document any pre-existing damage at pickup. Photos at handover form part of the rental record.
- Return the scooter at the agreed time. Late returns incur a fee of RM 20 per hour beyond a 30-minute grace, or one full extra day for > 4 hours.
- Full-tank-out, full-tank-in. If returned with less fuel than at pickup, we deduct the fuel cost plus a RM 10 refill fee.
6. Customer obligations
- Ride safely, obey Malaysian traffic laws, and wear the helmet provided at all times.
- Do not exceed posted speed limits or carry more than the legally permitted number of pillion riders.
- Do not use the scooter for racing, off-road riding (unless designated for the model), commercial passenger transport, or any illegal activity.
- Park in legal, secure locations. Use the steering lock and disc lock (if provided).
- Notify us immediately of any accident, theft, breakdown, or police interaction via WhatsApp.
7. Damage, loss & fines
- You are responsible for all damage, loss, theft, or vandalism during the rental, except where caused solely by manufacturer defect or our negligence.
- Repair costs are deducted from your deposit. If costs exceed the deposit, the balance is invoiced and payable within 14 days.
- Traffic compounds, parking tickets, or summonses issued during your rental are your responsibility. We may process the compound on your behalf and recover the amount plus a RM 30 admin fee.
- Loss of helmet: RM 100 each. Loss of key: RM 150 + locksmith call-out. Loss of phone holder: RM 30. Damaged tyre (puncture excepted): RM 80–150.
- If the scooter is rendered unrideable due to your fault, you are liable for daily rental loss until the unit is repaired and back in service (capped at 7 days).
8. Insurance
Scooters carry third-party-only insurance as required by Malaysian law. You are not covered for own-damage, theft, or pillion injury under this basic policy. We strongly recommend purchasing personal travel insurance covering motorcycle use.
9. Liability
To the maximum extent permitted by Malaysian law, BitScoot's total aggregate liability for any claim arising from a rental is limited to the rental fee paid for the affected rental, except in cases of death, personal injury caused by our gross negligence, or other liability that cannot be excluded by law.
10. Personal data
We process your data in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010 (as amended 2024).
11. Governing law & disputes
These Terms are governed by the laws of Malaysia. Disputes are subject to the exclusive jurisdiction of the courts of Langkawi, Kedah, except where applicable consumer protection laws permit you to bring proceedings in your place of residence.
12. Changes
We may revise these Terms from time to time. The "Last updated" date above shows the current version. Bookings made before a change continue under the version in force at the time of booking.
